Project Update: March 2024

The Minister for Planning has approved Amendment C215king to the Kingston Planning Scheme, which applies the Heritage Overlay (HO128) to 86 Mentone Parade, Mentone on a permanent basis, with minor administrative changes.

The Amendment came into operation on 22 March 2024 when notice was published in the Victorian Government Gazette

Overview

Council has been working with heritage consultants to undertake a review of its Heritage Study. 86 Mentone Parade, Mentone has been identified as potential place of significance within their preliminary work.

While we are in the early stages of a longer process to update our Heritage Study, we recently received a demolition application for the dwelling. Council sought an urgent assessment from our heritage consultants which showed that the site meets the criteria for local heritage significance and recommended that a Heritage Overlay be applied to the property.

Application of a Heritage Overlay requires a formal Planning Scheme Amendment process. On 19th January 2023 Council sought authorisation from the Minister for Planning to commence a Planning Scheme Amendment C215 for a permanent Heritage Overlay over land at 86 Mentone Parade, Mentone.

Authorisation has been granted from the Minister and we are now exhibiting the Amendment for feedback.

What is a Heritage Overlay?

The Heritage Overlay is a planning control within the Victoria Planning Provisions. A Heritage Overlay is applied to areas (or precincts), or individual buildings, land, gardens, trees or other items that have been determined to be of cultural heritage significance.

The overlay ensures that heritage places are conserved and enhanced, and that development does not negatively impact the significance of the heritage place. It’s a tool to manage change rather than to prohibit development or the continued use of heritage places.

To ensure heritage properties are protected, planning permission is required from Council to demolish, construct, alter or extend buildings and/or structures in the Heritage Overlay.

Council has legislative obligations under the Planning and Environment Act 1987 to ensure places of heritage significance are conserved and enhanced by the Heritage Overlay so that the identity of a place can be enjoyed by future generations.

What is an interim Heritage Overlay?

Interim heritage controls are typically applied to protect places of significance whilst permanent controls are being processed through a full Planning Scheme Amendment. This ensures that a planning permit is required to demolish the building and that consideration would need to be given to heritage matters in the assessment of any current or future permit application.
