Notice is given pursuant to sections 119 and 223 of the Local Government Act 1989 (the Act) that Kingston City Council proposes to amend its Community Local Law ("Principal Local Law") by making an amending local law pursuant to Part 5 of the Act to be known as the Community (Amendment) Local Law No. 2 ("proposed Local Law").
Purpose and general purport of the proposed Local Law
The purpose and general purport of the proposed Local Law is to amend the Principal Local Law by:
incorporating new Councildefinitions; and
revising the regulation of :
the removal of protected trees;
the obstruction to free use of a road;
street stalls;
tapping into drains;
interference with water courses;
road occupation and works;
construction of vehicle crossings;
failure to obtain an Asset Protection Permit;
failure to comply with a notice following a site inspection.
A copy of the proposed Local Law can be obtained from Council’s Customer Service Centre at 1230 Nepean Highway, Cheltenham 3192, 8.30am-5.00pm. Alternatively you can view a copy online at www.kingston.vic.gov.au/Community/Your-Kingston-Your-Say
Any person may make a written submission on the proposed Local Law to Council. All submissions received by Council on or before Thursday 30 November 2017 will be considered in accordance with section 223 (1) of the Act, by Council’s Submissions (Section 223) Committee ("Committee").
If a person wishes to be heard in support of their submission they must include the request to be heard in the written submission and this will entitle them to appear in person, or by a person acting on their behalf before a meeting of the Committee scheduled to be held on Tuesday 5 December 2017, commencing at 4.30pm.
Written submissions should be marked for the attention of the Governance Manager and can either be lodged at Council’s Customer Service Centre at 1230 Nepean Highway, Cheltenham or mailed to Council at PO Box 1000, Mentone VIC 3194. Submissions can also be made online via Council’s www.yourkingstonyoursay.com.au website.
Submissions are not confidential and will be incorporated in full (including all personal information) into the agenda and minutes of the Council Meeting at which they are considered; will be available on Council’s website as part of the relevant agenda and minutes of meeting; and will be made available for public inspection in accordance with all applicable statutory requirements, including, those prescribed by the Act.
